We have reviewed the footage of the shrub removal to establish whether there are any controls in place to prevent this activity, however the works that are taking place do not appear to constitute development and there does not appear to be any breach of planning legislation. The site is not in a Conservation Area, or subject to a Tree Preservation Order. The scrub/shrubs that have been removed would not be considered to constitute a hedgerow under the Hedgerow Regulations. Unless 5 cu metres of timber is removed a Felling Licence is not required. There is no planning permission in place on the site so there are no planning conditions to control the use of the land.
The video of the fox family is very clear. If any wildlife is being disturbed this may constitute an offence under the Wildlife and Countryside Act 1981 and should be reported to the Police. If any building works or material change of use of the land occurs then this would potentially constitute a breach of planning control, and we can look into this matter further.
